Thailand’s Cannabis Policy: A Timeline from 2019 to 2026
24/10/2026Last updated October 2026.
In 2023 this article was about “cannabis tourism”, comparing Thailand with destinations such as Amsterdam and Denver. A lot has changed since then. Thai tourism authorities now state plainly that recreational use has never been legally permitted in Thailand, and since June 2025 cannabis flower has been a controlled herb, supplied only on a Thai prescription.
This rewritten guide focuses on something more practical: what the rules mean when you are travelling. It covers carrying cannabis inside Thailand, flights, borders, and hotels. For the basics, such as prescriptions and age limits, see our page on cannabis rules in Thailand for visitors.
Carrying cannabis within Thailand
Government guidance for tourists says cannabis flower may only be used, bought, carried or transported with a valid prescription issued in Thailand by a licensed practitioner. The prescription covers a stated quantity for no more than 30 days. If you are carrying cannabis flower that was supplied to you, keep your prescription with you as proof that you obtained it legally.
Two points are easy to miss:
- Extracts are different. Cannabis extracts containing more than 0.2% THC by weight are still controlled as Category 5 narcotics. Possessing one for personal use can bring up to two years in prison, a fine of up to 40,000 baht, or both.
- Foreign paperwork does not count. Prescriptions and medical cannabis cards from other countries are not recognised in Thailand.
Domestic flights
The government guidance allows a prescription holder to carry and transport cannabis flower, but it does not set out airline or airport procedures. Airlines and airport security can apply their own rules, so check with your airline before you fly, carry your prescription, and never use cannabis in an airport or on board. If you are not sure, the simplest choice is not to fly with it.
International flights: do not take cannabis out of Thailand
This is the most important point in this guide. A Thai prescription does not authorise export, import, or possession while in transit through another country. Exporting cannabis flower legally requires a licence under Section 46 of the Thai Traditional Medicine Act, and the Thai government says cannabis exports are allowed only for medical purposes with authorisation from both Thailand and the destination country.
The penalties are serious:
- Unlicensed export of cannabis flower can bring up to one year in prison, a fine of up to 20,000 baht, or both. Unlicensed export of extracts is a narcotics offence carrying up to five years and a fine of up to 500,000 baht.
- Since 17 June 2026, the Customs Department fines people caught trying to take cannabis out of Thailand 30,000 baht per kilogram, and the cannabis is confiscated.
- Smuggling can bring up to 10 years in prison, a fine of four times the value of the goods including duties, or both.
Enforcement is active. Between 1 October 2025 and 30 June 2026, Thai authorities recorded 3,309 cannabis cases involving more than 37,000 kg, and 3,266 of those cases were attempted exports. In July 2026, Thai Customs and the UK’s National Crime Agency launched a joint partnership on cannabis border controls. Thai officials say airport and cargo X-ray systems can detect cannabis in any form.
Remember too that your destination has its own laws, and carrying cannabis on a flight to a country where it is illegal is a serious offence. In August 2026, two travellers were reportedly detained in Hong Kong during a stopover on a flight from Thailand, with cannabis in their luggage.
Never carry bags for someone else
Thai and French media reported in 2026 that young travellers had been recruited through social media with offers of a free trip to Thailand, in return for carrying bags home. At least 11 French nationals were arrested at a Thai airport with several kilograms of cannabis in their luggage, and some said they did not know what they were carrying. Never accept a bag, parcel or “gift” to carry across a border, however friendly the offer.
Land borders and sea crossings
The same rule applies whether you leave by air, road, rail or boat. Do not place cannabis in checked luggage, hand luggage, parcels, or any vehicle crossing an international border. That includes edibles and small amounts of flower.
Hotels, condos and short-term rentals
Having a prescription does not override the rules of the place you are staying. Hotels, serviced apartments and condominiums can set their own rules on smoking and cannabis, so read the house rules or ask before you arrive.
Smoke and odour that disturbs others counts as a nuisance under the Public Health Act B.E. 2535, and ignoring an official order to stop can bring up to three months in prison, a fine of up to 25,000 baht, or both. E-cigarettes and vapes are illegal in Thailand, so do not use them in your room or anywhere else. Our etiquette guide for visitors in Pattaya has more on being a considerate guest.
Before you pack: a checklist
- Buy only from a licensed shop, with a Thai prescription and your ID.
- Keep your prescription with you while you are in Thailand.
- Check your airline’s rules before any domestic flight.
- Check your accommodation’s rules before you arrive.
- Before you leave Thailand, make sure there is no cannabis in any bag, pocket or vehicle.
- Never carry luggage or parcels for anyone else.
Rules are still changing
On 22 September 2026, the Cabinet approved a draft Cannabis Control Bill that would limit cannabis strictly to medical use and toughen penalties. It now goes to the House of Representatives and is not yet law. Check official sources from the Ministry of Public Health and the Customs Department before you travel.
